Doubleheader · Rain Delay
Many Balls in the Air
Reed-Jennings v. The Baseball Club of Seattle, L.P. (2015)
Charge: Negligence - fan hit in the face during visiting-team batting practice (suit against the club)Court: Court of Appeals of Washington, Division OneDocket: Rain Delay
Did the club breach its limited duty, and did the fan assume the risk of being hit during batting practice?
The facts
An adult fan arrived early for a big-league game and sat two rows from the field along the right-field foul line while the visiting team took batting practice. During practice, several balls can be in play at once. A foul ball struck her in the face, causing serious eye injuries. She knew from past games that foul balls reach the stands but said she did not appreciate that multiple balls are in play during practice. The trial court granted summary judgment for the club, and the appeals court had to decide.
