Ballpark on the Parkland

Save Our Parks v. Kempthorne (2006)

Charge: Unlawful federal approval - converting grant-funded parkland for a new stadium (challenge to the federal approval)Court: U.S. District Court for the Southern District of New YorkDocket: Stadium Wars

Did the federal government lawfully approve turning grant-funded parkland into a stadium site?

The facts

A city planned to build a new stadium for its storied big-league team on two neighborhood parks next to the old ballpark. Some of the park land had received federal grants, so converting it needed federal approval and replacement parkland of equal value. The National Park Service approved. A community group sued, calling the approval arbitrary and biased and the replacement parks inadequate.
