One Gram in Big Sky

United States v. Steve Howe (1992)

Charge: Attempted possession of cocaine (federal misdemeanor)Court: U.S. District Court for the District of MontanaDocket: Rain Delay

Is trying to buy a single gram of cocaine from an informant enough for a federal drug conviction?

The facts

A relief pitcher with a long record of drug suspensions had made an impressive comeback. In the off-season, near his rural home, he tried to buy one gram of cocaine for $100 from a man who turned out to be a drug agency informant working an unrelated case. He pleaded not guilty at first. His agent said he had passed a series of drug tests, and the pitcher suggested he had been stopped before using anything.
