The facts

A woman at a 1947 ballgame was first seated behind protective netting, then an usher moved her to an unscreened seat. She asked whether it was safe there, and the usher allegedly told her yes. Shortly after, a foul ball struck and injured her. She sued the club, arguing it failed to warn her of the danger and, worse, falsely assured her the seat was safe.
