The facts

Two community colleges played a preseason baseball game in 2001. After a pitcher from the visiting team hit a home batter, the home team's pitcher allegedly threw at the next visiting hitter in retaliation. The pitch struck him in the head and cracked his helmet. He complained of pain and dizziness, but the host school's staff gave him no medical attention. He sued the host college district.
