The Doctor's Fever

Bush v. Commonwealth (1880)

Charge: MurderCourt: Kentucky Court of AppealsState: KentuckyDocket: Chain Reaction

The facts

A man shot a woman with a pistol. The wound was not the kind that usually kills, and she began to recover. But the doctor treating her was himself getting over scarlet fever. He carelessly passed the disease to her, and she died of the fever, not of the gunshot. The accused was tried for murder. The law asks whether the death flowed naturally from the wound, or whether something else stepped in between and caused it instead.
