The facts

Regional councils pushed for years to ban drift gill nets from a coastal mackerel fishery. A regional director turned the ban down. A newly appointed senior administrator, who had publicly backed the ban in an earlier state job, then approved it. Wholesalers and two commercial fishermen sued, saying he had no power to override the director, had prejudged the question, and that landings showed no overfishing to cure.
