The Commentator Flown Home
Chandler v. United States (1948)
Charge: Treason (enemy propaganda broadcasts)Court: U.S. Court of Appeals, 1st Cir.State: MassachusettsDocket: Treason
The facts
An American-born writer moved to Europe and settled in the enemy country, which he came to admire. During the war he worked as a paid radio commentator for the enemy's state broadcaster, among its best paid, using a made-up name. His broadcasts to American listeners pushed hatred of Jews and defeatism. After the war the Army arrested him abroad and flew him home for trial. He argues his acts happened abroad, his forced return was unlawful, and mere words cannot be treason.
