The facts

A man in his forties had a progressive disease that hardened his skin and internal organs. He lost his appetite and up to twenty-five pounds, and suffered nausea, vomiting, diarrhoea and trouble swallowing. Many medicines had failed him and one doctor suggested surgery on his gullet. He grew and smoked marijuana, and two of his doctors said it did appear to ease those symptoms. He asked to put a medical necessity defence to the jury.
