The facts

A devoted fan who had been to well over a hundred home games was sitting in the stands when the team's costumed mascot began tossing foil-wrapped hot dogs into the crowd as a promotion. One hot dog struck the fan in the face. He later needed surgery for a detached retina and sued the club. A first jury blamed the fan entirely, but the state's top court threw that verdict out and ordered a new trial. A second jury then heard the case.
