Toss Between Innings

Dalton v. Jones (2003)

Charge: Negligence - fan hit by a player's throw between innings (suit against the player and the club)Court: Court of Appeals of GeorgiaDocket: Double Play

Can a fan in unscreened seats recover when a player's throw between innings hits her?

The facts

A woman at a major-league game sat in an unprotected section of the grandstand. Between innings, as she began to head toward the concession stand, she was struck in the face by a ball thrown by a star outfielder, either during warm-up throws with a teammate or as a toss after catching the final out. She suffered an eye injury and facial disfigurement and sued both the player and the team, arguing the throw was careless and players should be trained not to endanger fans.

You have the facts the court had. Guilty or not guilty? Call it in the game with your friends, then see what the court actually decided. Wrong call, you drink.
