A Check Is Not Cash?
Ex parte Hall (2016)
Charge: Second-degree theft of property - writing himself a $1,500 check from a veterans chapter's accountCourt: Supreme Court of AlabamaDocket: Strange Charges
Was Hall's conviction valid when the indictment said currency but he took a check?
The facts
James Hall was commander of a Disabled American Veterans chapter in Houston County. In 2013 he wrote himself a $1,500 check from the chapter's bank account, saying it reimbursed expenses from his duties, and deposited it in his personal account without chapter approval. When the chapter asked for documentation and repayment, he refused. His indictment charged him with taking 'United States currency.' At trial the proof showed he took the money by check, and Hall argued that a check is not currency.
