The Shed in Guin

Ex parte Mills (Jamie Ray Mills) (2010)

Charge: Capital murder - elderly couple beaten during a robbery at their homeCourt: Supreme Court of Alabama (trial: Marion County Circuit Court)Docket: Death in Dixie

Should a jury believe the co-defendant wife's account that he committed the killings?

The facts

On June 24, 2004, a man and his common-law wife went to the home of an 87-year-old man and his 72-year-old wife in Guin, Marion County, Alabama, intending to rob them. The couple were attacked in a storage shed with a machete, a tire tool and a hammer. The husband died of head and neck injuries; his wife died months later from her head wounds. At trial the man testified he was not involved, while his common-law wife testified that he carried out the attacks as she watched. There was evidence both had used methamphetamine beforehand.
