The Union Preamble

Fiske v. Kansas (1927)

Charge: Criminal syndicalism under state lawCourt: U.S. Supreme CourtState: KansasDocket: The Red Scare

The facts

A man signed up new members for a labour organisation. To persuade them he read out the preamble to the organisation's constitution, which said workers and employers have nothing in common and that the wage system should be abolished by organising industrially. A state law made it a crime to advocate crime, violence, arson, destruction of property or sabotage as a way to bring about industrial or political change. That preamble was the only evidence against him.

You have the facts the court had. Guilty or not guilty? Call it in the game with your friends, then see what the court actually decided. Wrong call, you drink.
