The Courier at the ATM

Gavin v. State (2003)

Charge: Capital murder - shooting of a courier during a robbery at a bank ATMCourt: Alabama Court of Criminal Appeals (trial: Cherokee County Circuit Court)Docket: Death in Dixie

Did the State prove the accused, rather than his cousin, was the gunman?

The facts

On March 6, 1998, a 68-year-old contract courier was servicing an ATM at a bank in Centre, Alabama, when a man approached his van, shot him twice, pushed him into the passenger seat and drove off. A police investigator spotted the van and turned on his emergency lights; the driver stopped, got out, fired at the investigator and ran into the woods. The courier died at the hospital. A gun was later found and linked by ballistics to the shooting. The accused man had arrived in town in his cousin's car.
