The Illustrated Government Report

Hamling v. United States (1974)

Charge: Mailing obscene material and conspiracy to mail itCourt: U.S. Supreme CourtState: CaliforniaDocket: Banned

The facts

A publisher put out an illustrated version of an official government report on pornography. To advertise it, he and his associates mailed a brochure to more than fifty thousand people across the country. The brochure carried sexually explicit photographs showing various sex acts. Federal law makes it a crime to send obscene matter through the mail. The accused say the law is too vague, that the jury was wrongly told to apply a national standard, and that the government did not prove they knew the material was obscene.

You have the facts the court had. Guilty or not guilty? Call it in the game with your friends, then see what the court actually decided. Wrong call, you drink.
