He Asked the Prosecutor First

Hopkins v. State (1949)

Charge: Displaying signs to solicit marriagesCourt: Court of Appeals of MarylandState: MarylandDocket: House Deck

The facts

A minister lived in a small town known for quick weddings. In one month he performed 286 of the 1,267 marriages in the county. He put up two lit signs: one at his home with his name and title, another on the highway saying 'Notary Public, Information'. A state law bans signs meant to attract people to be married. Before putting up the signs he asked the county's chief prosecutor, who told him they would be legal. He was prosecuted anyway. The judge would not let the jury hear about the prosecutor's advice.
