The Book With No Pictures
Kaplan v. California (1973)
Charge: Selling an obscene bookCourt: U.S. Supreme CourtState: CaliforniaDocket: Banned
The facts
The owner of an adult bookstore sold a paperback to a plain-clothes police officer. The book had a plain cover and no pictures at all. It was made up entirely of repeated descriptions of sex acts. The buyer was an adult, and nobody claimed the book was sold to children. The owner was charged with selling obscene material. He argues that written words alone, with no illustrations, cannot be obscene and are protected as free speech. He also says the state needed expert witnesses to prove the book was obscene.
You have the facts the court had. Guilty or not guilty? Call it in the game with your friends, then see what the court actually decided. Wrong call, you drink.
