The facts
The publisher of an underground newspaper was charged on two counts. The first was for printing small photographs of a nude man and woman beside a news story about a local photographer arrested for taking such pictures. The second was for printing an explicit poem about sex, placed among other poems on a poetry page. He was convicted on both counts and given two consecutive one-year terms and $1,000 fines. He argues the photos were part of a news report and the poem was an attempt at serious art.
