The facts
A man was arrested for a break-in. Police then came to suspect him of a killing. His sister called the public defender about the break-in. A lawyer phoned the station. She was told he would not be questioned that night. Within the hour, detectives questioned him about the killing. Before each session he was read his rights and signed a form saying he did not want a lawyer. He confessed. He was never told a lawyer had called. He says that makes his waiver invalid.
