The County Chairman

Noto v. United States (1961)

Charge: Knowing membership in an organisation advocating violent overthrow of the governmentCourt: U.S. Supreme CourtState: New YorkDocket: The Red Scare

The facts

A county chairman of a communist party was prosecuted under a federal law making it a crime to belong to a group that advocates the violent overthrow of the government. Informants described party classes on revolutionary writings, a plan to place members inside key industries, and his own remarks about a coming clash with the federal government. Nobody said he had urged anyone to use force now. The disputed point is whether teaching that revolution will one day come counts as advocating violence.
