Just to Get Even
People v. Brown (1894)
Charge: Burglary (entering a house intending to steal)Court: Supreme Court of CaliforniaState: CaliforniaDocket: House Deck
The facts
A seventeen-year-old boy was staying at a house, doing chores for meals. Another boy there threw oranges at him and they quarrelled. To get even, he went into the house and took a bicycle, meaning to take the other boy's but grabbing a different one by mistake. He hid it in some brush, planning to bring it back that evening. He was caught first. He was charged with burglary: entering the house intending to steal. Theft here requires intent to keep the property for good. The jury was told a temporary taking could be enough.
