Three Dead in an Apartment

People v. Burnstein (1933)

Charge: First-degree murderCourt: Supreme Court of Michigan (on appeal from the trial court, Wayne County / Detroit Recorder's Court)State: MichiganDocket: Prohibition

The facts

Three men were shot dead inside an apartment. The prosecution said members of a rival group had lured them there and killed them in revenge for the earlier death of one of their own. One witness said he saw an accused man driving a car away from the building straight after the shooting. Another witness said he saw a car leave but that this accused was not the man at the wheel. The case turned on whether the jury could rely on the identification.
