The facts

A labourer's six-year-old son fell gravely ill. A doctor treated the boy and promised to return the next morning, but did not come. The child died. When the doctor finally arrived around midday, the father believed the doctor's treatment had killed his son. He thought he saw the doctor smile at the news. In a rage he choked the doctor, fetched a knife from a closet and stabbed him twice in the throat. He was charged with first-degree murder, which requires a deliberate, premeditated intent to kill.
