The Refund That Wasn't
People v. Davis (1998)
Charge: Petty theft with a prior theft convictionCourt: Supreme Court of CaliforniaState: CaliforniaDocket: Sticky Fingers
The facts
A man walked into a department store, took a men's shirt off the display rack, and carried it to a sales counter in another department. He said he wanted to return it: he had bought it for his father and it did not fit. Asked for a receipt, he said it was a gift. A store security officer had watched everything and told the cashier to issue a credit voucher. The man signed it with a false name and was stopped. His defence: he never meant to keep the shirt, only to get a refund.
