The facts

A man shared an apartment with a roommate. After a quarrel, he went to a neighbour and borrowed a shotgun. He walked back into the apartment he lived in and shot his roommate in the side and arm. He was charged with assault with a deadly weapon. Prosecutors also charged him with burglary: entering a dwelling with intent to commit a felony. He argued that he lived there and had every right to walk in. The question is whether a person can burgle his own home.
