People v. Hernandez (1993)

Charge: Felony murderCourt: New York Court of AppealsState: New YorkDocket: High Crimes

The facts

Two men planned to rob a man entering an apartment building. One waited in the stairwell with a gun while the other lured the target inside. The target was in fact an undercover state trooper, with backup close by. The gunman ran into a courtyard, still armed. Police ordered him to stop. Instead he aimed his gun at an officer and kept coming. The officers opened fire and one officer was killed. The fatal bullet came from a fellow officer, not either robber. The felony murder law asks whether the robbers 'caused the death'.

You have the facts the court had. Guilty or not guilty? Call it in the game with your friends, then see what the court actually decided. Wrong call, you drink.
