The Roster of Undercover Agents

People v. Kunkin (1973)

Charge: Receiving stolen propertyCourt: Supreme Court of CaliforniaState: CaliforniaDocket: Sticky Fingers

The facts

A mail clerk at a state law-enforcement office took a personnel roster listing the names, home addresses and phone numbers of undercover narcotics agents. He brought it to an underground newspaper, asked for twenty dollars if it was published, and insisted the sheet be returned afterwards. The editor and a reporter printed the list in full. What they did not know was that the clerk had already left the office's employ when he handed it over. The editor and reporter were charged with receiving stolen property. The law requires proof they knew it was stolen.
