The Brothers and the Shotguns
People v. Menendez (2005)
Charge: First-degree murder (lying in wait) and conspiracy to commit murderCourt: U.S. Court of Appeals, Ninth CircuitState: CaliforniaDocket: Trial of the Century
The facts
Two brothers in their early twenties shot their wealthy parents dead with shotguns in the family home. At first they told police it was a mob hit. In the months after, they spent freely from the millions they stood to inherit. Later they admitted the killings but said years of abuse by their father left them in fear for their lives. The law here allows a lesser verdict if that fear was honest, even if unreasonable. The prosecution says they lay in wait and planned the killings.
