The facts
At 2 a.m. a driver well over the alcohol limit crashed into another car at a crossroads. The other car spun round and stopped near the middle of the road. Its driver and passenger were barely hurt. They got out, checked on the drunk driver, then went back to their wrecked car to switch on its hazard lights, as its headlights were dead. While they stood beside it, a third car struck and killed the passenger. The accused says the passenger's own choice to go back into the road, not the crash, caused his death.
