The Hernia Operation
People v. Stewart (1976)
Charge: MurderCourt: New York Court of AppealsState: New YorkDocket: Chain Reaction
The facts
During a confrontation at his ex-girlfriend's apartment, a man stabbed another man in the stomach. Surgeons operated to repair the wound. During the same operation they found an unrelated hernia and decided to fix it too. While they were working on the hernia, the patient's heart stopped. His brain was starved of oxygen, and he died a month later without waking up. The medical examiner admitted several things could have stopped the heart, and that the patient probably would have survived without the hernia surgery. The accused was charged with murder.
