Hidden Behind the Batteries

People v. Tran (2014)

Charge: Over-limit take (Dungeness crab)Court: California Superior Court, San Mateo CountyState: CaliforniaDocket: The Poacher's Docket

Were the pair taking crab far over the limit and doing it for sale rather than for the table?

The facts

A husband and wife came back into harbor in an eighteen-foot speedboat after a day on the water. A warden asked to see the catch. Stowed around the boat were a hundred and eight crab: twenty in an ice chest, sixteen in a canvas bag, fifty-six stacked behind the batteries and sixteen more in built-in compartments. Without a commercial license the two of them could lawfully keep twenty between them.
