The facts
A clerk working at a city newsstand sold two paperback novels to a plainclothes police officer for $1.65. The books were cheap pulp fiction with sexual themes. The clerk was charged with selling obscene books and convicted. He argues the books are protected by the constitutional guarantee of free speech and press, and that selling them to an adult who asked for them, with no pandering and no exposure to children, cannot be a crime.
