First Game, Last Tooth

Romeo v. The Pittsburgh Associates (2001)

Charge: Negligence, contract and consumer-protection claims - first-time fan hit by a foul ball in unscreened box seats (suit against the club)Court: Superior Court of PennsylvaniaDocket: Rain Delay

Does a ballclub owe a first-time fan in unscreened seats any duty to protect or warn her about foul balls?

The facts

An out-of-state visitor went to her very first big-league game and sat in unscreened box seats six rows from the field along the third-base line. She glanced away from the action for a moment and a foul ball smashed into her face, knocking out teeth and causing nerve damage. She and her husband sued the team, arguing it should have warned her, screened more seats, and that selling her that ticket broke consumer-protection laws.

You have the facts the court had. Guilty or not guilty? Call it in the game with your friends, then see what the court actually decided. Wrong call, you drink.
