The facts

A fan was in a club dining area at the end of the third-base line at a minor-league ballpark. Unlike other sections, the area had no protective netting. A foul ball struck him in the face, costing him an eye. He sued the team. The team asked the court to adopt the widely followed baseball rule, which shields clubs that provide some screened seating, and to throw the case out before trial.
