The facts

A banker at a large bank shared secret merger news with his brother, to whom he was very close. The brother passed the tips to the accused, a friend and in-law, and told him the banker was the source. The accused traded on the tips and made over $1.5 million, splitting it with another relative. The law says a tip is illegal only if the insider got a personal benefit. The accused says the banker got nothing: no money and nothing of value.
