The facts
A public school teacher was charged under a new state law that banned teaching that man descended from lower animals rather than the Bible's story of creation. He was convicted and fined $100. On appeal he argues the law is unconstitutional: it is too vague, interferes with education and favours one religion. The state says, as employer, it may control what its schools teach. There is another issue: the state constitution says fines over $50 must be set by a jury, and here the judge set it.
