One Section Past the Net
South Shore Baseball, LLC v. DeJesus (2014)
Charge: Negligence and premises liability - fan blinded in one eye by a foul ball just past the netting (suit against the club)Court: Supreme Court of IndianaDocket: Foul Territory
Was the club liable for not extending its netting to cover her seat?
The facts
An adult fan attended a minor-league game and sat in a section just beyond the end of the protective netting behind home plate. Early in the game a foul ball struck her in the face, fracturing bones and leaving her permanently blind in one eye. Her ticket, posted signs and public-address announcements all warned about balls entering the stands. She sued, arguing the club should have extended the netting farther. The trial court refused to dismiss.
