Cutting the Trap Lines

State v. Bunker (2010)

Charge: Elevated aggravated assault (self-defense)Court: Maine Superior Court, Knox CountyState: MaineDocket: Overboard

Was the shot fired on the wharf lawful defense of himself and his family, or an unlawful armed assault?

The facts

An island tradition kept the lobster grounds for local families. The Defendant's son-in-law began setting traps there and the others objected. Gear was cut. One morning a man boarded the Defendant's boat and threatened to kill him and was driven off with pepper spray. Two men then chased the son-in-law's boat. The Defendant's daughter ran to the wharf with a loaded shotgun. He arrived with a revolver and fired twice.
