The Thing Downstream

State v. Sanders (2024)

Charge: First-degree murderCourt: Oklahoma District Court, Pontotoc CountyState: OklahomaDocket: Overboard

Did the Defendant kill with the state of mind murder requires, given what he says he believed at the time?

The facts

Two men went hand-fishing for catfish in a river, reaching into underwater holes to grab them. The Defendant later said he saw a twelve-foot creature standing downstream. He said his companion kept pressing him to keep fishing, and he took that as a plan to drown him and feed him to the creature. He beat the man and strangled him. Officers thought he was under the influence of something.

You have the facts the court had. Guilty or not guilty? Call it in the game with your friends, then see what the court actually decided. Wrong call, you drink.
