State v. Shine (2018)
Charge: Aggravated murder (three victims), attempted murder and felonious assault - mass shooting inside a barbershop, and the later killing of a witnessCourt: Ohio Court of Appeals, Eighth Appellate District (Cuyahoga County)Docket: Close Shaves
Was the defendant the gunman, and could the jury hear the words of a witness who had been killed?
The facts
At about 7:30 p.m. on February 5, 2015, a gunman in a black hooded sweatshirt walked into the Chalk Linez Barbershop in Warrensville Heights, Ohio and opened fire. Three men died, including a co-owner of the shop and a man who was shot about 20 times and had ties to a rival gang; several other people were wounded. A cosmetologist, a barber and another man who was there identified Douglas Shine Jr. as the shooter, and DNA on shell casings was attributed to him. A man parked outside told police he saw Shine leave with a gun in each hand. That man was shot dead four months later, before trial, and his statements were put before the jury.
