The Plant Would Not Stop
State v. Warshow (1979)
Charge: Unlawful trespassCourt: Vermont Supreme CourtState: VermontDocket: House Deck
The facts
A nuclear power plant had shut down for repairs and refuelling. A group of protesters blocked the entrance so workers could not go in and restart it. They were charged with trespass. They wanted to tell the jury they acted out of necessity. They offered expert evidence that the plant's cooling system had dangerous defects that could cause a meltdown and radiation harm, and said that danger outweighed a trespass. The trial judge would not let the jury hear any of it.
