Seventh-Inning Stretch · Heads Up!
Warm-Up Throws
Taylor v. Baseball Club of Seattle, L.P. (2006)
Charge: Negligence - fan hit in the face by an errant pre-game warm-up throw (suit against the club and players)Court: Washington Court of AppealsDocket: Heads Up!
Is being hit by a stray warm-up throw before the game an inherent risk of attending?
The facts
Before a 2000 big-league game in Seattle, a fan stood in her seat four rows up along the right-field line, looking away from the field. Two pitchers were playing catch to warm up. One throw got past the other pitcher and hit her in the face. She sued the club and the players, arguing the game had not started and fans should not have to watch warm-ups.
You have the facts the court had. Guilty or not guilty? Call it in the game with your friends, then see what the court actually decided. Wrong call, you drink.
