Thurmond v. Prince William Professional Baseball Club, Inc. (2003)
Charge: Negligence - fan hit in the face by a line-drive foul ball in unscreened bleachers (suit against a minor-league club)Court: Supreme Court of VirginiaDocket: Heads Up!
Does an adult fan who sits in an unscreened area assume the risk of a foul ball as a matter of law?
The facts
A woman sat high in the unscreened bleachers along third base at a minor-league game. In the eighth inning a line-drive foul ball struck the right side of her face, fracturing bones around her eye and damaging nerves. She sued the club, saying its warnings were inadequate and that the field's layout and lighting made the seats unsafe.
You have the facts the court had. Guilty or not guilty? Call it in the game with your friends, then see what the court actually decided. Wrong call, you drink.
