A woman attending a minor-league game sat at a table in the stadium's beer garden, an upper-level concession area several hundred feet from the playing field. From her seat she could not see the field. A foul ball flew into the area and struck her in the face, knocking her unconscious. She said she never saw it coming. She and her husband sued the operator, which won summary judgment.
