Grouper in Name Only
United States v. Blyth (2011)
Charge: Seafood mislabeling & smugglingCourt: U.S. District Court, S.D. AlabamaState: AlabamaDocket: Busted!
Is selling one fish under the name of a costlier one a crime rather than a trade description problem?
The facts
A wholesaler sold fish under names they did not deserve. Farm-raised Asian catfish and African lake perch went out as grouper. Imported farmed shrimp was sold as American wild-caught, and small shrimp were billed as larger grades that fetch more. At the border, about 283,500 pounds of farmed catfish were declared as wild sole, a fish carrying no anti-dumping duty, avoiding roughly $145,625.
