The Breathing Tubes

United States v. Hamilton (1960)

Charge: Second-degree murder (tried by judge alone)Court: U.S. District Court, District of ColumbiaState: District of ColumbiaDocket: Chain Reaction

The facts

After an argument in a pool hall, two men fought in the street. The accused knocked the other man down, then jumped on his face and kicked his head. In hospital, doctors put tubes into the injured man's throat to keep him breathing. Early the next morning he had a convulsion, pulled the tubes out himself, and died within the hour from breathing in blood. The accused, charged with murder, says the man's own act of pulling out the tubes caused the death, not the beating.
