The Borrowed Car
United States v. Heredia (2007)
Charge: Possession of marijuana with intent to distributeCourt: U.S. Court of Appeals for the Ninth Circuit (en banc)State: ArizonaDocket: Night Session
The facts
A woman borrowed her aunt's car to drive her mother home from a town near the border. At an inland checkpoint agents noticed a very strong perfume smell and found about 349 pounds of marijuana in the boot, packed with dryer sheets. Her mother seemed nervous and carried a lot of cash. The woman testified she had noticed a detergent smell before leaving and did not believe her aunt's story about spilled fabric softener. She said she only grew suspicious after the last exit, when stopping was too dangerous. The offence requires that she knew.
