Orders From a Prison Cell

United States v. Hoover (1997)

Charge: Continuing criminal enterprise; conspiracy to distribute cocaine and heroinCourt: U.S. District Court, N.D. Ill. (appeal: 7th Cir.)State: IllinoisDocket: Kingpins

The facts

A man already serving a state prison sentence is accused of still running a large street gang's drug business from his cell. Prosecutors say he directed the sale of cocaine and heroin across the state and bribed guards with cash and drugs to stay in touch with the outside. Much of the evidence came from secretly intercepted conversations. He argues the government had no proper legal authority for the interceptions and for its roving surveillance, so the recordings should be thrown out. The main charge is running a 'continuing criminal enterprise', meaning leading a drug business.
