The Leader Not at the Shootout

United States v. James (1976)

Charge: Conspiracy to assault federal officers, and assault on federal officersCourt: U.S. Court of Appeals, Fifth CircuitState: MississippiDocket: True Believers

The facts

Federal agents and city police went to a political group's headquarters to arrest a wanted man. Heavy gunfire came from inside. A police detective was killed and an FBI agent badly wounded. The accused, the group's president, was at a different building during the shootout. Prosecutors said he ran security, told members to shoot intruders, and warned police his group would be ready for them. He argued he was the leader of a foreign nation and immune from prosecution. Conspiracy does not require being present.
